By accessing or using the Sulcus Learning Inc. (“Sulcus Learning”) website, mobile applications, content, or services (collectively, the “Platform”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, you must stop using the Platform immediately.

1. Acceptance of Terms

These Terms govern your use of the Platform. Continued use constitutes acceptance of any updates or modifications.

2. About Sulcus Learning

Sulcus Learning provides educational content, simulated assessments, and preparation tools for Canadian nursing licensure exams including NCLEX-RN®, REx-PN™, and CPNRE®. Sulcus Learning is not affiliated with NCSBN®, CNO, BCCNM, Meazure Learning, or any Canadian nursing regulatory body. All trademarks belong to their respective owners.

3. Eligibility

You must be at least 18 years old or have parental/guardian consent.
You may use the Platform only for educational and lawful purposes.
You must not violate exam confidentiality, academic integrity, or regulatory rules.

4. License to Use

Sulcus Learning grants you a limited, non-exclusive, non-transferable, revocable license for personal study use only.

You may not share accounts or login credentials.
You may not copy, reproduce, modify, or distribute Platform materials.
You may not use content commercially or for tutoring services.
Violations may lead to immediate termination of access.

5. Intellectual Property

All content—questions, text, software, algorithms, images, and proprietary data—belongs to Sulcus Learning Inc. or its licensors and is protected under Canadian and international intellectual property laws.

6. Payment & Subscription Terms

Subscriptions must be paid in full at the time of purchase.
Subscriptions are non-transferable.
Refunds are issued only where required by law or under Sulcus Learning’s published refund policy.

7. No Guarantee of Results

Sulcus Learning does not guarantee exam results or licensure outcomes. Performance depends on individual effort, study habits, and external factors beyond our control.

8. Assessment Tools & Analytics

Readiness assessments, scoring models, and difficulty ratings are proprietary tools meant to assist learning. They are not official exam predictions.

9. Service Availability

We do not guarantee uninterrupted or error-free access. Outages, maintenance, or updates may occur.

10. Limitation of Liability

To the fullest extent allowed by Canadian law, Sulcus Learning’s liability shall not exceed the amount paid for your subscription.

Sulcus Learning is not liable for:

Lost profits or income
Loss of opportunities
Exam failure
Data loss
Indirect, incidental, or consequential damages

11. Indemnification

You agree to indemnify and hold Sulcus Learning harmless from claims caused by misuse, violations, or breach of these Terms.

12. Privacy

Use of the Platform is subject to our Privacy Policy, which complies with PIPEDA and other provincial privacy laws.

13. Termination

We may suspend or terminate your account at our discretion in cases of misconduct, unauthorized use, or policy breach.

14. Governing Law

These Terms are governed by the laws of Ontario and the federal laws of Canada. Courts of Ontario have exclusive jurisdiction.

15. Modifications

Sulcus Learning may update these Terms at any time. Continued use after updates constitutes acceptance of the modified Terms.

Sulcus Learning Inc. is an independent educational provider.
We create practice questions, simulated exams, and study resources for Canadian nursing licensure exams, including the NCLEX-RN®, NCLEX-PN®, REx-PN™, and CPNRE®. We are not affiliated with, endorsed by, or sponsored by any exam developer, regulator, or testing agency, including:

National Council of State Boards of Nursing (NCSBN®)
College of Nurses of Ontario (CNO)
British Columbia College of Nurses and Midwives (BCCNM)
Meazure Learning / Yardstick
Any provincial or territorial nursing regulatory body in Canada

All exam names, logos, and trademarks remain the exclusive property of their respective owners.

No Guarantee of Results

Exam performance depends on many factors, including individual study habits, test-taking ability, prior knowledge, and personal circumstances. Although Sulcus Learning Inc. provides high-quality study tools, we do not guarantee a passing score or licensing outcome on any regulatory examination.

Any pass-rate figures, performance indicators, usage statistics, or readiness recommendations are based on internal data, historical user trends, or publicly available information. Such data reflects past cohorts only. Individual results will vary.

Educational Use Only

Our readiness assessments, scoring models, difficulty algorithms, and question banks are proprietary educational tools. They are designed to help learners gauge preparedness, but they are not official predictors of performance on NCLEX-RN®, REx-PN™, or CPNRE® examinations.

Technology & Platform Use

While Sulcus Learning Inc. aims to maintain a stable and accessible online platform, we make no guarantees regarding uninterrupted service, compatibility with all devices or browsers, or error-free performance.

Limit of Liability

To the fullest extent permitted by Canadian law, Sulcus Learning Inc.’s liability for any claim related to the use of our products or services is limited to the amount paid for your subscription. We are not responsible for indirect, incidental, special, or consequential damages arising from use or inability to use our platform, assessments, or content.

Use of this site may include security features such as reCAPTCHA, and by accessing the platform you agree to all applicable third-party privacy and service terms.
